Bail is a financial agreement made for a criminal defendant. The primary drive behind the bail system is to assure the appearance of a criminal defendant in court. A bail bonding agency such as Exit Bail Bonds can arrange to pay a bond to have the defendant released from jail awaiting the trial. The court sets the value of the bail, which can be paid in full or a percentage upfront and the rest on the day of the hearing. Simply put, a bail bond is a surety that the full amount will be settled and the defendant will appear in court on the set date. Exit Bail Bonds provides 24-hour bail bond services throughout Riverside, Orange County, Los Angeles, and San Bernardino. If you have any inquiries regarding how bail bonds work, please don’t hesitate to contact us anytime.

What Happens After an Arrest?

Once an arrest is made, the defendant is taken to the county jail or a local city jail. The defendant will then go through the booking process, which includes:

  • Identity verification
  • Fingerprinting
  • Photograph or mug shot
  • Formal charges
  • Interrogation
  • Bail determination

Also, the suspect’s personal belongings are cataloged and held and this means that the suspect will be left with no access to cellphones, money, or credit cards. This booking process takes about 2 to 5 hours to complete.

Acquiring a Bail Bond

A bail bond agency is contacted by the defendant’s relative, lawyer, friend, or the defendant him/herself. Bail services only start after the arrest and booking processes are complete. The bail bond agency will then start by collecting basic information regarding the defendant’s situation. To assess the risk involved, bondsmen in most cases will ask several questions such as where the detainee is being held, where is their place of work, how long they’ve been there, what the charges are, etc. If the bail bond company determines that the Bailee poses no risk of appearing in court on the set and there are no government holds on the defendant, then the bail bond is made available for purchase. The customer making the purchase will need to sign a bail bond application form, a bail indemnity agreement, and a receipt.

After the paperwork is finalized, the bail bond will be posted at the appropriate jail or detention facility and this will result in the defendant being released. Defendants in city jails are released much faster after bond is posted. But the process in County jail often takes between 3 and 8 hours or longer depending on how busy the jail is or other factors. Before signing the bail bonds, all the parties are made to understand their rights and responsibilities. The quicker the bail gets posted the better and at Exit Bail Bonds, we do our best to get all the paperwork processed and finalized as quick and easy as possible. Our primary responsibility then shifts to ensuring that the defendant appears at every court hearing that’s scheduled for their case.

The bond may be revoked if the court has a reason to believe that the defendant has left the area or has plans not to attend the hearing. An arrest warrant will be issued and the defendant will be returned to jail. If this does not happen, their bond will be forfeited and the co-signer will be left with the burden of paying the full amount. Conversely, the co-signer has the right to revoke the bond themselves and remove their financial obligation if they no longer wish to be held accountable. After this, the defendant will then be put in custody as they await their hearing.

What Charges Require a Bail Bond?

Most criminal charges qualify for some form of bail or bail bond. Cash bonds are applicable when the offenses are considered minor. Normally, cash bonds do not exceed $1,000 and must be paid in full and in cash at the jail. The services of a bail bonds agents may not be required in this case because the amount is so small. Criminal charges are classified as either felonies or misdemeanors, which are then classified into Classes A, B, C, or D, depending on the severity of the crime. If you’re curious about the charges filed against you and what type of bail bond amount is required, get in touch with a criminal defense attorney or call our office. Most crimes have a pre-determined bond schedule that allows the jail to state the appropriate amount needed and also allows a bail bond agent to post bail.

If the severity of the crime is extreme or the defendant has been charged with multiple crimes, they may be required to appear at an arraignment hearing. At this point, the judge may choose to deny bail if they have reasonable belief that the defendant may escape or poses a threat to themselves or others. While a defendant and their loved ones are guaranteed the ability to post bond in accordance to the 8th Amendment of the Constitution, the judge has the discretion to revoke that privileged if it’s in the best interest of the case and the community.
